Terms of Use

The terms on which you may use CashBharo.

This document is complete but has not yet been reviewed by a lawyer.

It describes accurately what CashBharo does with your data today, and we intend to follow it. It has not yet been through legal review, and the company registration it will name is still in progress. If anything here matters to you, please ask us at support@cashbharo.com before relying on it.

Who we are

These Terms of Use govern your use of cashbharo.com and every service offered on it. The site is operated by TRIVAAN DIGITAL (OPC) PRIVATE LIMITED, a One Person Company incorporated in India, referred to below as “CashBharo”, “we”, “us” or “our”. Our registered office address, corporate identity number and contact email are published on this site and form part of these terms.

By creating an account or by using the site, you agree to these terms. If you do not agree, please do not use the site.

1. What CashBharo is, and what it is not

CashBharo is an affiliate marketing platform. We list offers from online retailers, which we call Stores. When you visit a Store through a link on our site and complete a qualifying purchase, the Store or its affiliate network pays us a commission. We pass a share of that commission back to you. We call your share cashback.

We are not a seller. We do not stock, ship, bill for, price or warrant anything you buy from a Store. Your purchase contract is with the Store alone. Product descriptions, prices, availability, delivery, cancellation, returns, warranties and refunds are governed entirely by that Store’s own terms, and any dispute about them is between you and the Store.

We are not a bank, a payment system operator, or an issuer of a prepaid payment instrument. Your cashback balance on CashBharo is our record of a rebate we expect to owe you. It is not a deposit, it does not earn interest, it cannot be spent at any Store, it cannot be transferred to another person or to another account, and it can be paid out only to a bank account or UPI identifier held in your own name.

2. Who may use the site

You may use CashBharo if you are at least 18 years old, resident in India, and competent to contract under the Indian Contract Act, 1872. We do not knowingly provide services to anyone under 18.

One person may hold one account. An account belongs to a natural person, not to a business, and is for that person’s own shopping. You are responsible for everything done through your account and for keeping your password and any second factor secure. Tell us at once if you believe someone else has access to it.

3. Your account

You must give us accurate information and keep it current. If the name on your account does not match the name on the bank account or UPI identifier you give us for payout, we cannot pay you, and we will ask you to correct it before we do.

You may close your account at any time by writing to us. Closing your account ends your right to any pending cashback that has not yet been confirmed, because that money has not yet reached us either. Any confirmed balance at or above Rs 250 can be withdrawn before you close the account, and we will tell you so before acting on a closure request.

4. Cashback

Cashback is a promotional benefit, not a fee we owe you for a service you have performed. How it is earned, tracked, confirmed, reversed and paid is set out in full in our Cashback Terms, which form part of these terms. Please read them. The most important points are these, and they are repeated there:

  • Cashback depends on the Store reporting your order to us. Tracking can fail for reasons outside our control, and we cannot promise that every purchase will track.
  • Cashback is confirmed only after the affiliate network has paid us for it, which for most Stores is around three months after your order.
  • If you return or cancel an order, the cashback on it is reversed.
  • Rates shown on the site are the maximum we expect to pass on, and are subject to change by the Store at any time.

5. Referrals

If we run a referral programme, you may invite people you actually know. You may not spam, buy traffic, create accounts on behalf of other people, use incentivised or misleading advertising, or bid on our brand name in paid search. Referral rewards for invitations that breach this section are cancelled, and repeated breaches will close your account.

6. Things you must not do

You must not:

  • open more than one account, or use another person’s account or payout details;
  • place orders you intend to cancel or return in order to generate cashback, or order in bulk for resale through a consumer account;
  • use software that automates, repeats or fakes clicks, orders or page visits;
  • misrepresent yourself as CashBharo, or use our name, logo or content without written permission;
  • attempt to access parts of the site you are not authorised to reach, probe or test its security, or interfere with its operation;
  • scrape, copy or republish our Store listings, rates or content for a competing service;
  • use the site for anything unlawful, or in a way that breaches a Store’s own terms.

If we have reasonable grounds to believe you have done any of these, we may suspend your account while we look into it, cancel affected cashback, and if the finding stands, close the account and forfeit the balance attributable to the breach. We will tell you why, and you may respond through the grievance process in section 14.

7. Availability of the site

We try to keep the site available, but we do not promise uninterrupted service. We may change, suspend or withdraw any part of the site, any Store listing or any offer, at any time. We may need to take the site down for maintenance, usually with notice.

8. Our content

The CashBharo name, logo, design, text and software are ours or are licensed to us, and are protected by Indian law. Store names, logos and trade marks belong to those Stores, and are shown to identify their offers. Nothing on the site grants you a licence to use any of these.

9. Third party sites

Our links take you to Stores we do not control. We are not responsible for their content, their terms, their privacy practices or the goods and services they sell. Once you leave our site you are governed by theirs.

10. Our liability

Nothing in these terms limits any liability that cannot lawfully be limited, including liability for fraud, or for death or personal injury caused by negligence.

Subject to that: we provide the site as it is. We do not warrant that a purchase will track, that a Store will honour an offer, or that the site will be free of error. We are not liable for any indirect or consequential loss, for loss of profit, or for any loss arising from a Store’s acts or omissions.

Where we are liable to you, our total liability for all claims arising in any twelve month period is limited to the higher of the confirmed cashback balance in your account at the time the claim arises, or Rs 250.

11. Indemnity

If we suffer a loss because you broke these terms or used the site unlawfully, you agree to cover it. That includes a claim brought against us by a Store, an affiliate network or another person because of what you did, and the reasonable costs of dealing with such a claim.

This applies only to loss actually caused by your own act or omission. It does not apply to loss we could reasonably have avoided ourselves, nor to anything you did in good faith on the strength of something we told you. If a claim arises that we expect you to cover, we will tell you promptly, let you take part in how it is handled, and not settle it without asking you first.

12. Events outside our control

We are not responsible for a delay or a failure to do what these terms require where the cause is genuinely outside our control. That includes failures of power, networks or hosting, acts of a government or a regulator, strikes, natural events, war, epidemics, and a Store or an affiliate network failing to report, confirm or pay a commission.

Where such an event happens we will tell you if we reasonably can, and we will do what we reasonably can to limit its effect on you. Our obligations are suspended while it lasts rather than cancelled, and cashback you have already earned is not lost because of one.

13. Privacy

We handle your personal data as described in our Privacy Notice, which forms part of these terms and is written to the Digital Personal Data Protection Act, 2023.

14. Complaints and grievance redressal

If something has gone wrong, write to our grievance officer. Their name, email address and postal address are published on this site.

We will acknowledge your complaint within 2 days and aim to resolve it within 30 days of receiving it. If a complaint needs information from a Store or an affiliate network, resolution can take longer than the underlying payment cycle, and we will keep you told.

If you are not satisfied, you may approach the consumer forums under the Consumer Protection Act, 2019, or the National Consumer Helpline.

15. Changes to these terms

We may change these terms. If a change materially affects your rights, we will give you notice on the site and, where we have your email address, by email, at least 15 days before it takes effect. Cashback already earned is governed by the terms in force when you earned it. Continuing to use the site after a change takes effect means you accept it.

16. Governing law and jurisdiction

These terms are governed by the laws of India. The courts at Ghaziabad, Uttar Pradesh have exclusive jurisdiction, without prejudice to any right you have under the Consumer Protection Act, 2019 to complain to a consumer forum where you live.

17. General

If any part of these terms is found unenforceable, the rest continues to apply. If we do not enforce a right immediately, we do not lose it. You may not transfer your rights under these terms to anyone else. We may transfer ours to a group company or to a buyer of the business, on notice to you.
